Аннотация: "Discussions on U.S. border enforcement have traditionally focused on the highly charged U.S.-Mexico boundary, inadvertently obscuring U.S.-Caribbean relations and the concerning asylum and detention policies unfolding there. Boats, Borders, and Bases offers the missing, racialized histories of the U.S. detention system and its relationship to the interception and detention of Haitian and Cuban migrants. It argues that the U.S. response to Cold War Caribbean migrations actually established the legal and institutional basis for contemporary migration and detention, and border-deterrent practices in the United States. This book promises to make a significant contribution to a truer understanding of the history and geography of the U.S. detention system overall."--Provided by publisher.

Аннотация: "Law and Society Today is a fresh, contemporary, problem-oriented survey of sociolegal studies. While other texts focus heavily on criminal procedure, this book provides the essentials, focusing on significant historical and political changes of the last two decades, including neoliberalism, migration, multiculturalism, and the dominance of economics in law teaching, policy debates, and judicial decision-making. Each chapter presents key concepts, real world applications, and hypothetical problems for students to test comprehension. With an integrated approach to theory and practice and written in an accessible tone, this text helps students recognize the dynamic forces that shape the way the law is constructed and implemented, particularly how law drives social inequality"--Provided by publisher.

Аннотация: "The findings of forensic science--from DNA profiles and chemical identifications of illegal drugs to comparisons of bullets, fingerprints, and shoeprints--are widely used in police investigations and courtroom proceedings. While we recognize the significance of this evidence for criminal justice, the actual work of forensic scientists is rarely examined and largely misunderstood. Blood, Powder, and Residue goes inside a metropolitan crime laboratory to shed light on the complex social forces that underlie the analysis of forensic evidence. Drawing on eighteen months of rigorous fieldwork in a crime lab of a major metro area, Beth Bechky tells the stories of the forensic scientists who struggle to deliver unbiased science while under intense pressure from adversarial lawyers, escalating standards of evidence, and critical public scrutiny. Bechky brings to life the daily challenges these scientists face, from the painstaking screening and testing of evidence to making communal decisions about writing up the lab report, all while worrying about attorneys asking them uninformed questions in court. She shows how the work of forensic scientists is fraught with the tensions of serving justice--constantly having to anticipate the expectations of the world of law and the assumptions of the public--while also staying true to their scientific ideals."--Inside jacket cover.

Аннотация: For over sixty million Americans, possessing a criminal record overshadows everything else about their public identity. A rap sheet, or even a court appearance or background report that reveals a run-in with the law, can have fateful consequences for a person's interactions with just about everyone else. The Eternal Criminal Record makes transparent a pervasive system of police databases and identity screening that has become a routine feature of American life. The United States is unique in making criminal information easy to obtain by employers, landlords, neighbors, even cyberstalkers. Its nationally integrated rap-sheet system is second to none as an effective law enforcement tool, but it has also facilitated the transfer of ever more sensitive information into the public domain. While there are good reasons for a person's criminal past to be public knowledge, records of arrests that fail to result in convictions are of questionable benefit. Simply by placing someone under arrest, a police officer has the power to tag a person with a legal history that effectively incriminates him or her for life. In James Jacobs's view, law-abiding citizens have a right to know when individuals in their community or workplace represent a potential threat. But convicted persons have rights, too. Jacobs closely examines the problems created by erroneous record keeping, critiques the way the records of individuals who go years without a new conviction are expunged, and proposes strategies for eliminating discrimination based on criminal history, such as certifying the records of those who have demonstrated their rehabilitation. -- from dust jacket.

Аннотация: Faith in the power and righteousness of retribution has taken over the American criminal justice system. Approaching punishment and responsibility from a philosophical perspective, Limits of Blame takes issue with a criminal justice system that aligns legal criteria of guilt with moral criteria of blameworthiness. Many incarcerated people do not meet the criteria of blameworthiness, even when they are guilty of crimes. The author underscores the problems of exaggerating what criminal guilt indicates, particularly when it is tied to the illusion that we know how long and in what ways criminals should suffer. Our practice of assigning blame has gone beyond a pragmatic need for protection and a moral need to repudiate harmful acts publicly. It represents a desire for retribution that normalizes excessive punishment. Kelly proposes that we abandon our culture of blame and aim at reducing serious crime rather than imposing retribution. Were we to refocus our perspective to fit the relevant moral circumstances and legal criteria, we could endorse a humane, appropriately limited, and more productive approach to criminal justice.--

Аннотация: Life imprisonment has replaced capital punishment as the most common sentence imposed for heinous crimes worldwide. As a consequence, it has become the leading issue in international criminal justice reform. In the first global survey of prisoners serving life terms, Dirk van Zyl Smit and Catherine Appleton argue for a human rights-based reappraisal of this exceptionally harsh punishment. The authors estimate that nearly half a million people face life behind bars, and the number is growing as jurisdictions both abolish death sentences and impose life sentences more freely for crimes that would never have attracted capital punishment. Life Imprisonment explores this trend through systematic data collection and legal analysis, persuasively illustrated by detailed maps, charts, tables, and comprehensive statistical appendices. The central question--can life sentences be just?--is straightforward, but the answer is complicated by the vast range of penal practices that fall under the umbrella of life imprisonment. Van Zyl Smit and Appleton contend that life imprisonment without possibility of parole can never be just. While they have some sympathy for the jurisprudence of the European Court of Human Rights, they conclude that life imprisonment, in many of the ways it is implemented worldwide, infringes on the requirements of justice. They also examine the outliers--states that have no life imprisonment--to highlight the possibility of abolishing life sentences entirely. Life Imprisonment is an incomparable resource for lawyers, lawmakers, criminologists, policy scholars, and penal-reform advocates concerned with balancing justice and public safety.--
