Аннотация: Since the mid-1990s, the European Union has defined the Asia Pacific as one of its key strategic targets on its ambitious road towards a global power. Over the past decades, big changes have taken place on both sides and the wider world. It's high time to evaluate the EU's performance in its Asian policy. In fact, the EU is at crossroads with its Asia Pacific policy. On several aspects, the EU is compelled to redefine its interests and roles, and rethink its strategies and policies towards the dynamic and ever important Asia Pacific region. This volume addresses this theme, by elaborating the general context, major issues and countries in the EU's Asia Pacific policy. It covers issue areas of traditional security, economy and trade, public diplomacy, and human security and focuses on the EU's relations with China, Japan, the ASEAN countries, and Australasia

Аннотация: The European Union has long suffered from a lack of democratic accountability. In the past decade, the problem has become particularly acute in the economic management of the Eurozone, the 19 countries of the E.U. that use the Euro (nine members don't). At present, the central institution for management of the Eurozone is the Eurogroup, an informal body led by national finance ministers who report neither to the European Parliament nor to national parliaments but coordinate their activities with the Troika, that is, the European Central Bank, the International Monetary Fund, and the European Council. Critics accuse the Eurogroup both of lack of transparency and of consistently putting the interests of the rich northwest ahead of the interests of poorer and smaller nations in the east and south. In How to Democratize Europe, four distinguished French scholars describe the diverse problems of the Eurozone and propose a treaty that would establish a parliament for economic policy consisting of selected members of national parliaments. Various contributors then respond to the proposal with support, criticism, or ideas for alternatives.--

Аннотация: Firm Dominance in EU Competition Law' explores the role of dominant firms in the competitive process, proposing that conduct should be scrutinized differently depending on the source of market power, rather than using the same approach for all dominant undertakings. There have been various high-profile investigations at national, international, and supranational levels, with the complexity of the tech issues adding to the many questions about effective enforcement. This has led to an increased focus on the effectiveness of rules intended to prevent abuse of dominance. How does it come about that a certain firm dominates a market? Can an understanding of this process lead to more effective enforcement of competition law? That is the question approached in this compelling book. The author reviews the European Union's (EU's) Article 102 case law, comparing it with United States (U.S.) provisions, demonstrating that new ways of looking at market power are needed-- today's tech giants differ from older monopolies.

Аннотация: Competition authorities intervene with the aim of discontinuing or preventing anti-competitive conduct but also of remedying the consequences thereof and restoring or preserving undistorted competition. In each case, the identification of the appropriate competition law "remedy?" is inherently linked to the identification of harm to competition and the articulation of a theory of harm. To be sure, not all theories of harm can be addressed by means of adequate competition remedies; alternative(regulatory/supervisory) remedies may instead have to be considered. Likewise, whether they are imposed or negotiated, remedies raise different questions, including in terms of judicial review and due process, but also in terms of reach and scope.

Аннотация: Competition enforcement authorities use settlements as a tool to ensure compliance with antitrust law. Companies can make commitments to remedy breaches, ensuring that they avoid litigation and potential fines and reputational damage. The author of this innovative book shows that, rather than fines or arguing principles of competition law in litigation, antitrust settlements (namely U.S. consent decrees and EU commitment decisions) hold the key to globally effective enforcement, particularly in the digital and blockchain era. Antitrust law does not necessarily need to be abolished, but rather should be fully exploited as an economic regulation led by antitrust settlements.

Аннотация: Companies engaged in FDI or financial services will appreciate the detailed analysis of issues raised by this new EU policy instrument. This book is supposed to improve the practitioners? understanding of the EU regulatory layer now coming on top of FDI screening at the Member State level. Practitioners active in competition law, particularly mergers and acquisitions, will welcome this clear commentary and analysis of a crucial component of EU policy in the related areas of trade and investment, and policymakers will be encouraged to consider whether further regulatory changes are called for.

Аннотация: General Principles of EU Law and the EU Digital Order' addresses the role of general principles in the era of digitalization and the (potential) impact of digitalization on the theory of general principles of union law. Digitalization of societies has important ramifications for citizens and businesses. The digital landscape is rapidly changing, whereas at the same time there are growing concerns about how market access in the European Union?s (EU?s) digital market as well as fundamental rights can be sufficiently safeguarded in the shadow of?big data? and algorithms. This book presents expert analyses of how digitalization raises questions of the future role for general principles of EU law, including the foundational principles of the EU?s fundamental economic freedoms and EU competition rules.

Аннотация: "Since the second edition (2010) of this invaluable book - primary texts with expert article-by-article commentary on European data protection, e-commerce and information technology (IT) regulation, including analysis of case law - there has been a marked shift in regulatory focus. It can be said that, without knowing it, EU citizens have migrated from an information society to a digital single market to a data-driven economy. This thoroughly revised and updated third edition pinpoints, in a crystal-clear format, the meaning and application of currently relevant provisions enacted at the European and Member State levels, allowing practitioners and other interested parties to grasp the exact status of such laws, whether in force, under construction, controversial or proposed."-- Wolters Kluwer CCH Website.
