Аннотация: This book provides a systematic overview of shareholders' duties found in European company law and capital market law. It is often assumed that shareholders have rights, not duties. In recent years, however, this assumption has come under intense scrutiny in all aspects of company law, and scholarship. In Europe especially, major changes are under way across a diverse spectrum, all the way from revised contractual arrangements to mandatory statutory provisions. Such a shift has important implications for the fundamentals of European company law, and there is a need to examine shareholders' duties and consider where this trend is taking shareholders and their stance in law. This focused collection of essays addresses this complex subjects from highly informative and useful variety of perspectives --

Аннотация: Increasingly, we conduct our lives online, and in doing so, we grant access to our personal information. The crucial feedstock of the world economy thus generated - the commercialization and exploitation of personal data and the intrusion of digital privacy it entails - has built an imposing edifice of market power. As we enter the third decade of the 21st century, this detailed exploration of the interlinkage between competition and data privacy takes a critical look at competition policy to evaluate whether the system in its current form and with the existing approach is capable of tackling the challenges raised by the role of personal data in the shift from an offline to an online economy.

Аннотация: 'Private Enforcement of European Competition and State Aid Law' addresses two key areas of European Union (EU) law, EU competition law and EU State aid law, in which private law enforcement has become increasingly important over the past years. The overlapping EU regimes of competition law and State aid law provide mechanisms allowing private plaintiffs to claim compensation for losses or damages. It is thus of significant practical value to provide, as this book does, analysis and guidance on achieving enforcement of such claims, written by renowned authorities in the two fields. This will be a unique new work, combining practical analysis with informed debate on understanding the rules of private enforcement on the EU level and the covered Member States.

   Conflict of laws.

   European Union countries.
Аннотация: With the so-called Rome I, II and III Regulations the Member States of the European Union are bound to a common set of rules for the choice of law in international private law disputes. They apply to both contractual and non-contractual disputes, their reach even extends to the application of non-Member State law. This poses great challenges to Courts and practitioners in every EU Member State, as there is only little case-law and doctrinal literature on the new rules, the uniform application of which will be overseen by the European Court of Justice. The Commentary answers to these challenges. It is an indispensable companion for both academics and legal professionals seeking their way through the Regulations. Renowned conflict of laws scholars comment every provision of the Regulations in a systematic, thorough and comprehensive manner, making them accessible to a broad international legal audience. Mirroring the German tradition of scholarly commentaries on Parliamentary Acts, the authors are selected from the distinguished group of relatively young German private international law scholars, whose exceptionally high qualifications are represented by their passing through the German Habilitation-system (second book requirement) as well as their proven ability to publish in the English language"--Provided by publisher.

Аннотация: "Personal data protection has become one of the central issues in any understanding of the current world system. In this connection, the European Union (EU) has created the most sophisticated regime currently in force with the General Data Protection Regulation (GDPR) (EU) 2016/679. Following the GDPR's recent reform - the most extensive since the first EU laws in this area were adopted and implemented into the legal orders of the Member States - this book offers a comprehensive discussion of all principles of personal data processing, obligations of data controllers, and rights of data subjects, providing a thorough, up-to-date account of the legal and practical aspects of personal data protection in the EU. Coverage includes the recent Court of Justice of the European Union (CJEU) judgment on data transfers and new or updated data protection authorities' guidelines in the EU Member States"--

Аннотация: "This book critically analyses under an ethical and legal point of view if the current food production process based on the industrialization of agriculture and over-exploitation of natural resources is appropriate to guarantee sustainable development, respectful of the right to adequate nutrition of future generations. The growth of the world population and the major request for nutriments raises the issue of how to conciliate the right to food with the protection of the environment and biodiversity, of human health and animal welfare. Few aspects of today's food system demand such an urgent response as our ability to produce sustainable nutrition. Yet at the same time as malnutrition plagues the world, overuse of land, water, and energy in the agricultural and livestock sectors exacerbates environmental degradation and climate change. This book focuses on the interrelation between food law, environmental law, and animal law, and investigates the main legal issues related to food regulation in a global context"--Provided by the publisher.

Аннотация: The complexities of implementing the General Data Protection Regulation (GDPR) continue to grow as it progresses through new and ever-changing technologies, business models, codes of conduct, and decisions of the supervisory authorities, and the courts. This eminently practical guide to implementing the GDPR - written in an original, problem-solving style by a highly experienced data protection expert with equal knowledge of both law and technology - provides a step-by-step project management approach to building a GDPR-compliant data protection system, assessing, and documenting the risks and then implementing these changes through processes at the operational level. With detailed attention to case law (Member State, ECJ, and ECHR), especially where affecting high-risk areas that have attracted scrutiny, the guidance proceeds systematically through such topics and issues as the following: required documentation, policies, and procedures; risk assessment tools and analysis frameworks; children's data; employee and health data; international transfers post-Schrems II; data subject rights including the right of access; data retention and erasure; tracking and surveillance; and effects of technologies such as artificial intelligence, biometrics, and machine learning. With its practical examples derived from the author's experience in building GDPR-compliant software, as well as its analysis of case law and enforcement priorities, this incomparable guide enables company data protection officers and compliance staff to advise on key issues with full awareness of the legal and reputational risks and how to mitigate them. It is also sure to be of immeasurable value to concerned regulators and policymakers at all government levels.
